1. Scope and Eligibility

1.1. These Terms and Conditions apply exclusively to all sales of seasoning container sets and related items offered through www.zestysavor.com to consumers residing within the European region.

1.2. By placing an order, you confirm that you are at least 18 years of age and possess the full legal capacity to enter into binding agreements.

2. Contract Formation

2.1. The presentation of products on our online store does not constitute a legally binding offer, but rather an invitation to place an order.

2.2. A binding purchase contract is concluded only when we accept your order by sending a formal order confirmation email to the email address provided during checkout.

2.3. All internal records, order logs, and transactional communications stored by the Company serve as evidence of the contract conclusion and transaction details.

3. Pricing and Payment Terms

3.1. All prices displayed on our website are denominated in the currency specified at checkout and include applicable taxes where relevant for European consumers.

3.2. Payment must be made in full at the time of placing the order using the authorized payment methods available on our checkout interface. Transaction processing is handled through standard encrypted protocols to uphold data protection.

3.3. The Company retains full ownership of all ordered items until complete payment has been received and verified.

4. Shipping, Delivery, and Transfer of Risk

4.1. We dispatch orders from our dedicated warehouse facility located in New Zealand. Orders are processed and dispatched within 1 to 2 business days following contract confirmation.

4.2. Delivery is carried out in cooperation with established priority international logistics providers, including DHL, FedEx, and UPS. The standard estimated delivery timeframe to destinations within the European region is between 7 and 12 business days from the date of dispatch.

4.3. To keep you informed of your shipment status, automated email updates are dispatched to your designated email address at key milestones, specifically upon initial dispatch from our facility, arrival at regional transit hubs, and when out for final local delivery.

4.4. In compliance with the European Consumer Rights Directive, the risk of loss, theft, or damage to the items transfers to the Customer only when you, or a third party designated by you (other than the carrier), take physical possession of the goods. Risk does not transfer upon delivery to the logistics carrier.

4.5. If a shipment fails to arrive within the standard estimated delivery window, the Customer should notify customer service. The Company will immediately initiate a formal inquiry with the respective logistics carrier. Following the outcome of this investigation, the Company will either issue a full refund of the purchase price or arrange for a complete reshipment of the items, based on the specific circumstances of the delay.

5. Right of Withdrawal (14-Day Cooling-Off Period)

5.1. Consumers residing within the European Union and the European Economic Area possess a statutory right to withdraw from this contract within 14 days without providing any justification.

5.2. The withdrawal period expires exactly 14 days from the day on which the Customer, or a third party nominated by the Customer (excluding the carrier), acquires physical possession of the final item included in the order.

5.3. To exercise the right of withdrawal, you must inform us of your decision through an unequivocal statement sent via email to seasoning@zestysavor.com before the 14-day period has elapsed.

5.4. Upon valid notice of withdrawal, we will reimburse all payments received from you for the corresponding items without undue delay and no later than 14 days from the date we receive your notification. The reimbursement will be processed using the identical payment method utilized for the original purchase, unless explicitly agreed otherwise.

5.5. The Customer is responsible for returning the items to our specified facility without undue delay and no later than 14 days from the day of notifying us of the withdrawal. The direct financial cost of returning the items is borne by the Customer.

6. Damaged or Defective Items

6.1. If an item arrives damaged, flawed, or defective, the Customer is entitled to legal remedies under consumer protection legislation.

6.2. To initiate a resolution, you must contact our support team at seasoning@zestysavor.com within a reasonable timeframe after delivery, providing clear photographic evidence demonstrating the damage or defect.

6.3. Once the evidence is verified by our customer care team, we will arrange for either a full refund or a complete product replacement, according to your preference. To ensure convenience, the Customer is not required to return the damaged physical items back to our warehouse; the provision of clear photographic verification is sufficient to finalize the resolution.

7. Limitation of Liability

7.1. The Company fulfills its commercial obligations with diligence and professional care. We accept liability for foreseeable losses and damages resulting directly from a material breach of our explicit contractual duties.

7.2. The Company shall not be liable for indirect, incidental, or consequential losses, nor for any delays arising from events beyond our reasonable control, including severe weather disruptions, customs enforcement delays, or regional postal interruptions.

7.3. Nothing within these terms purports to limit or exclude statutory consumer rights that cannot be lawfully waived or restricted under applicable New Zealand or European consumer protection frameworks.

8. Data Protection and Communications

8.1. We collect, store, and process customer information solely for order fulfillment, logistics handling, and statutory compliance. All data processing is managed in strict accordance with relevant regulatory standards, including the General Data Protection Regulation (GDPR).

9. Governing Law and Jurisdiction
